MPPLT, aguarda o pronunciamento do Governo de Angola por uma solução pacífica da Questão Lunda Tchokwe a sua Autonomia Os termos de nossa defesa é a nossa história natural da criação por DEUS, é o nosso estado e independência, é os nossos pressupostos jurídicos dos tratados de Protectorados de 1885 – 1894, assinados entre Portugal e Soberanos – Muananganas Lunda Tchokwe, a convenção de Lisboa de 25 de Maio de 1891, ractificado no dia 24 de Março de 1894 e trocado no dia 1 de Agosto do mesmo ano, entre Portugal e a Bélgica sob mediação Internacional da França, na presença da Alemanha, Inglaterra e do Vaticano.
Os outros termos de defesa são os artigos 3.º, 4.º e 7.º, alíneas a), b), c) e o n.º 2 do artigo 19.º, 20.º, 21.º e 60.º da Carta Africana dos Direitos do Homem e dos Povos, da Declaração Universal dos Direitos Humanos e dos Direitos Civis e Políticos.
O Movimento do Protectorado Português da Lunda Tchokwe, que em nome do Povo Lunda Tchokwe do Estado que defendemos legítima e publicamente, endereçar a pessoa impoluta de Sua Excelência o Presidente em virtude de ser o Primeiro Magistrado e o Primeiro Órgão da Soberania da Republica, com todas as prerrogativas e responsabilidades na Lei Constitucional, de conduzir os destinos dos Povos da Nação das Nações – Angola, ou de defender os seus bens jurídicos que DEUS lhes deu, o bem maior, a vida em prol do direito e da justiça, com os cordiais cumprimentos de alta consideração.
De acordo com os princípios do direito, o Movimento do Protectorado Português da Lunda Tchokwe esta diante de um facto histórico jurídico-natural, que não é a criação de um facto político para depois criarmos o facto jurídico, por isso segue a cronologia dos acontecimentos: A QUESTÃO DA LUNDA 1884/1894 – 1955/1975, a conclusão fora a de que, a Lunda Tchokwe é um protectorado Português.
Como na altura a Lunda Tchokwe não tinha o desenvolvimento científico que lhe permitisse, produzir a constituição formal ou Lei constitucional e formar o governo, então, foram protegidos todos os seus direitos naturais;
Artigo 4.º e 10.º do tratado n.º3 de 23 de Fevereiro de 1885ü
Artigo 4.º e 6.º do tratado n.º 5 de 2 de Setembro de 1886ü
Artigo 4.º do tratado n.º 7 de 1 de Dezembro de 1886
Artigo 8.º do tratado n.º 8 de 18 de Janeiro de 1887ü
A Lei N.º 8904 de 19 de Fevereiro de 1955, até aqui está em vigor, é um direito subjectivo, ou que, é um interesse cujo exercício e a sua reivindicação depende de nós Lunda Tchokwe, pelo facto de ser um acto que adveio por obrigação do cumprimento do acordo de protecção, a sua revogação, só seria contratual por representar os interesses dos dois contraentes ou Estados.
O Povo Lunda Tchokwe e o Povo Português ou seja os governos de ambas as partes, seria assim se Angola fosse Portugal. E por enquanto com respeito ao poder Politico Administrativo instituído nos termos do Artigo 5.º da Lei Constitucional, as negociações ou o dialogo deve ser feito entre Angola Independente e os Herdeiros Lunda Tchokwe representados pelo Movimento do Protectorado Português, sob fundamentos jurídicos do direito de sucessão.
Artigos 2024 e 2025 do Código Civil, em virtude destes acordos, tratados de amizade e comércio ou protectorados de 1885-1894, terem sido celebrados a luz de rudimentos de direito civil português do ano de 1800, terceira edição sob autoria de Cândido de Figueiredo, como resultado de programa aprovado por decreto de 14 de Outubro de 1800 da carreira de Legislação, que se leccionava aos alunos do 4.º ano do liceu.
A Republica de Angola até agora consome o mesmo direito civil e administrativo (do ano de 1800), aplicando-o, “mutatis mutandis” na política de administração do território, mesmo que tenha aprovado actualizações pontuais com novas normas na Lei.
No 30 de Março de 2015, a 3.ª Comissão de Relações Exteriores, Cooperação Internacional e Comunidades Angolanas no Estrangeiro da Assembleia Nacional de Angola, o seu parecer desfavorável à reivindicação de autonomia do Reino Lunda, no decorrer da sua décima terceira reunião ordinária, evocando constrangimento estruturante, advertindo com prevenir potenciais conflitos armados, motivados por disputas territoriais entre irmãos do mesmo Continente, citando a Carta da Organização da Unidade Africana e da União Africana que estabeleceu o princípio “uti possidetis” que conclama a intangibilidade das fronteiras herdadas das potências coloniais, como norma imperativa, é a mesma carta que instruiu os artigos 19º, 20º e 21º a favor dos direitos políticos dos povos e suas independências.
Na Conferência de Berlim 1884 – 1885, para a partilha de Africa, a questão da Lunda Tchokwe, não consta em nenhuma acta de integração como colónia de Portugal por força daquela reunião colonialista do século XVIII.
Os Movimentos de Libertação de Angola, FNLA, MPLA e a UNITA conheciam essa realidade a de que Lunda Tchokwe era sim um Protectorado Português, por esta razão o Estatuto do MPLA 1961 – 1977, no seu ponto II PROGRAMA MAIOR
– 1. – Independência Imediata e Completa,
2. – Unidade da Nação, na sua “alínea d) deste Programa dizia claramente o seguinte;
“As regiões onde as minorias nacionais vivem em agrupamentos densos e têm um carácter individualizado, podem ser AUTÓNOMAS”. Que minorias nacionais com características individualizadas, para dar Autonomia que se referia o Programa Maior do MPLA antes de 1975 e depois?
O mundo democrático e de direito, opta pelo diálogo principio da Sabedoria, como condição “sine qua non”, de resolução de qualquer tipo de conflito seja qual for sua magnitude, por falta de diálogo a guerra entre a Rússia e a Ucrânia ou a guerra de Israel com Hamas na palestina esta longe do seu termo.
No dia 3 de Agosto de 2007, o Movimento do Protectorado Português da Lunda Tchokwe, apresentamos um dossier da “Questão Lunda Tchokwe” ao Governo da Republica de Angola, aos Partidos Políticos, MPLA, UNITA, FNLA, PRS, BD entre outros e ao corpo Diplomático presente em Luanda e a Comunidade Internacional; a ONU, União Europeia, União Africana e ao VATICANO, em busca de solução pacifica por via de dialogo com as autoridades Angolanas para a Instauração de AUTONOMIA em troca da nossa independência.
O Movimento do Protectorado Português da Lunda Tchokwe, apela a solidariedade da Comunidade Internacional; as Nações Unidas, União Europeia, União Africana, países da SADC, países da CPLP e, em particular Portugal, Bélgica, Alemanha, França, Reino Unido da Inglaterra e o Vaticano, Igreja Angolana em geral e a CEAST, as Autoridades Tradicionais do Mosaico etnolinguístico e cultural, aos Partidos Políticos incluindo o próprio MPLA, os Deputados a Assembleia Nacional, Grupos Parlamentares e o Governo de Angola para a necessidade urgente do “DIALÓGO”.
Passados que são 17 anos (2007 – 2023) de uma luta pacifica acompanhada de perseguições, prisões politicas e condenações arbitrarias, o Movimento do Protectorado Português da Lunda Tchokwe, reafirma a sua disponibilidade desafiando as autoridades do Governo de Angola a “DIALÓGAR” com o MPPLT a qualquer momento e altura, com a presença de todas as forças vivas nacionais incluindo a Comunidade Internacional, na perspectiva de que todos juntos poderemos encontrar uma solução viável para a “Questão da Lunda Tchokwe” e juntos construirmos uma sociedade melhor, capaz de dignificar cada cidadão, de corrigir imediatamente as assimetrias ao desenvolvimento sustentável regional estadual e local.
Por tudo isto exposto nesta carta aberta, o Movimento do Protectorado Português e o Povo Lunda Tchokwe PEDE A SUA EXCELÊNCIA O PRESIDENTE DA REPUBLICA DE ANGOLA QUE, se digne exercer a Vossa Sofocracia de sempre para julgar Profundamente a matéria factual e a do Direito acima referenciado, para que PROMOVA IMEDIATAMENTE AS NEGOCIAÇÔES que culminarão com o estabelecimento da Justiça Real para a AUTONOMIA LUNDA TCHOKWE em 2024.
