“É sim preocupante, porque se olharmos para o artigo 1.º desta lei, que define o âmbito e o objecto da sua aplicação, diz claramente que aquela lei só se aplica em situações que resultam de condenações em processo penal, mas esta lei está ser aplicada em situações de processo que estão numa fase inicial”, afirmou Sérgio Raimundo.
O advogado criticou que a referida lei esteja a ser aplicada no período de instrução preparatória, “onde nem existe sequer uma condenação em processo penal”.
“Logo, nós estamos perante a violação do princípio da presunção de inocência que é um princípio estruturante de todo o sistema de justiça de Angola”, disse o causídico, à margem do 1.º Congresso da Nação: “Pensar Angola, por um Projecto Comum de Consenso”, organizado pela sociedade civil, que se iniciou em Luanda.
O SNRA, órgão da Procuradoria-Geral da República (PGR) angolana, foi instituído pela Lei sobre o Repatriamento Coercivo e a Perda Alargada de Bens.
A lei atribui como “principal missão” ao SNRA a localização, identificação e apreensão de bens, activos financeiros ou produtos relacionados ao crime, quer estes estejam em Angola ou no exterior do país.
Um despacho do SNRA, tornado público recentemente, dá conta da realização de um leilão de viaturas apreendidas no quadro de processos relativos ao ex-director do Instituto Nacional de Estradas de Angola, Joaquim Sebastião, e a Pedro Lussaty, major angolano detido em posse de vários bens, móveis e imóveis, e avultadas somas de dinheiro, guardado em malas, caixotes e viaturas.
Questionado sobre a “legalidade” do leilão, uma vez em que ambos os processos “ainda não transitaram em julgado”, Sérgio Raimundo manifestou-se indignado, referindo que “até há um processo em que SNRA ordena a venda destes bens que já não está sequer na alçada deste órgão”.
O processo “está na alçada do juiz, logo essas decisões têm que ser tomadas e proferidas no processo”, referiu.
“Estamos a falar de um Estado democrático e de direito, isto é arbitrariedade, isto é uma atrocidade jurídica inadmissível num Estado democrático de direito”, criticou.
E acrescentou: “Isto é usurpação de competências, porque neste momento o processo está na jurisdição de um juiz e só este juiz é que pode proferir esta decisão e não o Ministério Público”.
“Não tenho nenhuma ligação [com o processo Lussaty] e posso falar à vontade, já teve lugar uma instrução contraditória e quem sabe o mínimo de direito saberá que a instrução contraditória é dirigida por um juiz e não por um magistrado do Ministério Público”, explicou.
Segundo Sérgio Raimundo, a lei que cria o SNRA também está eivada de “incongruências” e recorda que a mesma “diz claramente que quem decreta o arresto dos bens ou apreensão é um juiz, não diz que é a PGR”.
O que diz o artigo 9.º, prosseguiu, “é que o Ministério Público requer a todo tempo a apreensão destes bens ao juiz, mas infelizmente o nosso legislador, ou por ignorância das regras do processo penal, aprovou uma lei que entra em contradição consigo mesmo”.
Sobre o actual processo de combate à corrupção, um dos eixos de governação do Presidente angolano, João Lourenço, o advogado considerou que “verdadeiramente em Angola não existe um combate à corrupção”.
“Provavelmente temos que descobrir o nome para atribuir a este processo, mas menos combate à corrupção”, respondeu à Lusa.
O combate à corrupção em Angola “não pode ser prender pessoas e bens, isto não é combater a corrupção, é preciso identificar as causas e atacá-las”, pois, caso contrário, “estamos a combater os corruptos de ontem, mas estão a surgir novos corruptos hoje”.
“E quando amanhã surgir um outro Governo também vão combater os corruptos de hoje e o país continuará com o seu futuro adiado se continuarmos a caminhar por esta direcção, tem que se ter coragem, ser patriotas e frontais e dizer o que queremos de facto”, frisou.
