DESPACHO JUDICIAL DETALHA COMO “LADRÃO TENTA EXTORQUIR OUTRO LADRÃO”
Um despacho do Tribunal de Comarca de Belas, datado de 20 de Setembro de 2023, que o Club-K teve acesso, trás pela primeira vez detalhes como a rede ligada ao gabinete do Juiz Presidente do tribunal Supremo, Joel Leonardo organizou-se para extorquir o antigo ministro dos transportes Agosto Tomas.

Os arguidos são o major Silvano António Manuel, sobrinho e oficial de justiça do Tribunal Supremo, e Augusto Trindade Simbo Bembele, ex-diretor do gabinete do ex-ministro dos Transportes Augusto da Silva Tomás.
De acordo com o despacho de pronúncia, os arguidos, em conluio, solicitaram ao ex-ministro Tomas a quantia de 3,5 mil milhões de kwanzas para evitar que ele fosse restituído à prisão.
Os factos, segundo conteudo do despacho que o Club-K partilha na integra, ocorreram em dezembro de 2022, após o ex-ministro ter sido posto em liberdade condicional.

No dia 31 de dezembro de 2022, o arguido Silvano Manuel, oficial de justiça do Tribunal Supremo, em comissão de serviço acumulava as funções de responsável da área do património do Conselho Superior da Magistratura Judicial e integrante da cápsula de segurança pessoal do conselheiro presidente do mesmo conselho, Joel Leonardo.
Tendo em atenção o local em que trabalhava, o arguido major Silvano Manuel tomou conhecimento da possibilidade de concessão de liberdade condicional em benefício do ofendido Augusto da Silva Tomás, na qualidade de arguido, no processo que tramitava na 3ª Secção da Câmara do Tribunal Supremo, com o processo número 02/19.
Assim, o arguido Silvano Manuel contactou o seu conhecido Paulo Jorge da Silva Ribas, pedindo-lhe que arranjasse alguém que fosse próximo do antigo ministro dos Transportes Augusto Tomás, porque, com a ajuda do seu superior hierárquico, o juiz Joel Leonardo, poderia facilitar o provimento do pedido de liberdade condicional e, como contrapartida, teria de arranjar dinheiro.
Acto contínuo, Paulo Ribas apresentou a proposta ao seu amigo e co-arguido Augusto Trindade Simbo Bembele, primo do ofendido Augusto Tomás e diretor do seu gabinete, quando exercia funções de ministro dos Transportes.
No dia 28 de dezembro de 2022, o ofendido Augusto Tomás foi posto em liberdade condicional, por decisão da Câmara Criminal do Tribunal Supremo.
No dia 31 de dezembro de 2022, por volta das 14h00, o co-arguido Silvano Manuel e o prófugo Paulo Ribas foram à residência do ofendido Augusto Tomás, localizado no Condomínio Atlântico Sul, Talatona, abordos de uma viatura de marca Lexus, matrícula LD-23-02-GY, estando o prófugo ao volante.
De frente à residência do ofendido, o co-arguido e sobrinho de Joel Leonardo, Silvano Manuel, pediu ao declarante Caetano Mendonça Caculo, funcionário da residência, que informasse a Dona Pique, esposa do ofendido Augusto Tomás, que o oficial do Tribunal Supremo pretendia transmitir uma mensagem do juiz presidente do Tribunal Supremo Joel Leonardo.
O declarante Caetano Caculo transmitiu o recado ao ofendido e à esposa, mas estes mostraram-se indisponíveis para falar com o co-arguido Silvano Manuel, dizendo que poderiam contactar o seu advogado.
Insatisfeito com a resposta, o co-arguido Silvano Manuel pediu ao mesmo funcionário da residência que informasse aos seus patrões para contactarem o co-arguido Augusto Bembele, pois ele dominava o assunto que o tinha levado lá.
Depois de se ausentarem do local, a declarante Defina Cumandala, TCP Dona Pique, orientou o seu motorista Carlos Ribeiro, que os seguisse e os fotografasse.
O co-arguido Silvano Manuel e o Paulo Ribas pararam nas imediações da sede do banco BIC Talatona, onde o co-arguido Silvano Manuel e a viatura com que circulava foram fotografados.
No dia 9 de janeiro de 2023, numa altura em que o antigo ministro e ofendido Augusto Tomás se encontrava na residência de sua outra esposa, Lídia Guimarães, no Talatona, compareceu o co-arguido Augusto Bembele e a sua esposa, Maria Mota.
Aí, o ofendido e o co-arguido dirigiram-se a um dos compartimentos da residência, no escritório, onde o co-arguido disse ao ofendido que as pessoas que estavam na residência dele estavam ligados ao Tribunal Supremo e pretendiam a quantia de 3 500 000 000,00 kwanzas, caso contrário o ofendido voltaria ao estabelecimento prisional no prazo de uma semana, pois o mandado de soltura passado em nome do ofendido apresentava-lhe algumas debilidades passíveis de se reverter a situação em seu desfavor.
O ofendido Augusto Tomás negou fazer a prestação do valor solicitado e deu a conhecer o que se estava a passar às autoridades através do declarante, António Capita.
Os coarguidos de forma livre, deliberada e conscientemente, mesmo sabendo que as suas condutas eram proibidas e punidas por lei. Os mesmos não têm antecedentes criminais.
