ADVOGADOS DO CASO LUSSATI PEDEM DESTITUIÇÃO DA DIRECTORA DO SERVIÇO DE RECUPERAÇÃO DE ACTIVOS
O jurista Francisco Muteka, disse esta sexta-feira 11 que os advogados do “caso Lussati” irão, nos próximos dias, escrever para à Ordem dos Advogados de Angola,(OAA) para solicitar o destituição de Eduarda Rodrigues, directora do Serviço Nacional de Recuperação de Activos (SENRA) junto do Conselho Superior dos Magistrados do Ministério Publico, pelas, consideradas, “ violações claras” da costituição e por estar a prestar um mau serviço à nação angolana.

Francisco Muteka, que falou nas vestes de jurista depois de um suposto telefonema da Ordem dos Advogados de Angola que orientou-o a não realizar a confência de imprensa como advogado de Pedro Lussati, considerouilegal o leilão das viaturas motorizadas apreendidos no quadro do processo, realizado pelo SENRA, no passado dia 28 de Julho, pelo facto de o processo se encontrar em instância judicial
De acordo com ele,houve uma ansiedade e pressa em se querer vender os bens dos arguidos desde o incio do processo,uma vez que não se encontra entre os bens , materiais perecivesis ou deterioráveis, contrariando Eduarda Rodrigues, Directora do SENRA, em entrevista à Televisão Pública de Angola, onde justificou o leilão como um processo que visa evitar a deterioração dos bens apreendidos.
“Os bens apreendidos, muitos deles em 2020 e 2021, estão a deteriorar-se permanentemente. Se formos aguardar pelo final do processo-crime, muito provavelmente, estes bens já não serão utilizáveis. Como estamos a falar de viaturas e embarcações que estão a deteriorar-se, há a necessidade de tomarmos uma decisão”, explicou a Directora do SENRA à TPA.
Muteka, salientou que , o SENRA na qualidade de órgão que autorizou o leilão, não tem legitimidade para o efeito e diz haver uma cumplicidade do juiz relator, desembarcador do Tribunal da Relação no processo.
O Jurista, disse que achou estranho, uma vez que a nível do processo, em instância anteriores, reclamaram, junto do tribunal, a inviabilização da realização e o leilão não chegou a acontecer o que, segundo ele, deixou os arguido satisfeitos pela norma legal cumprida.
Surpreendemente, disse o defensor de Pedro Lussati, no dia 28 de Julho, por via dos arguidos do processo, tomou-se conhecimento, por via de um despacho, que o SENRA teria realizado o leilão no domingo, 6 de Agosto.
“ Nós não entendemos, até ao presente momento, porque que foi o SENRA a autorizar a realização do leilão, não entendemos também o porque que o juiz relator deste processo permite a autorização da realização do leilão após a prolação do acórdão, uma vez que neste caso o tribunal perde o poder jurisdicional de se pronunciar no processo sobre questões de fundo”,questionou o jurista.
Segundo o defensor de Pedro Lussati,a forma a que considerou “atabalhoada” da realização do leilão levou com que o tribunal não notificasse os advogadosdo processo e nem os arguidos tal como mandam as normais.
