TRIBUNAL DOS EUA CHUMBA NOVO RECURSO DA AENERGY CONTRA ESTADO ANGOLANO
Um tribunal federal norte-americano rejeitou reavaliar o processo da eléctrica AEnergy contra o Estado angolano, concluindo que não há novas provas nem foram ignoradas as anteriormente apresentadas.
Em junho, a justiça norte-americana tinha já deferido a petição de Angola no sentido de rejeitar a acção da AEnergy, invocando uma decisão anterior de um tribunal nova-iorquino.
Na sentença proferida no dia 27 de outubro, a que a Lusa teve hoje acesso, o juiz que analisou o pedido de reavaliação da Aenergy, Trevor McFadden concluiu que o tribunal não ignorou qualquer prova e rejeitou os restantes argumentos da empresa.
A empresa está envolvida num contencioso jurídico com o Estado angolano desde 2019, quando foram rescindidos vários contratos com a empresa devido a alegadas irregularidades, acusações que a empresa rejeita, garantindo ter alertado o executivo angolano e ter executado vários projectos sem receber pagamento.
O processo remonta a 2017, altura em que a empresa de energia, liderada pelo português Ricardo Machado, foi contratada para construir e operar várias centrais estatais. O acordo foi financiado através de uma linha de crédito de 1,1 mil milhões de dólares com uma unidade da General Electric (GE), o qual estipulava que a AEnergy comprasse oito turbinas GE para aquelas centrais.
Na acção movida em maio de 2021, a AEnergy alegou que a GE falsificou documentos para difamar a eléctrica e assumir o seu trabalho e acusou o Governo angolano de concordar com o esquema para que pudesse cancelar os contratos antes do pagamento integral e apreender as quatro turbinas para seu benefício.
Angola foi absolvida, em primeira instância, na acção interposta pela AEnergy, porque o Tribunal de Recurso do Segundo Distrito de Nova Iorque entendeu que o foro adequado para julgar a causa era o angolano, tendo a empresa perdido igualmente o recurso.
Em abril de 2022, a justiça norte-americana recusou julgar um processo movido pela AEnergy contra o Estado angolano, relacionado com a rescisão dos contratos que tinha celebrado com o Governo para construir e operar centrais termoeléctricas, remetendo o caso para Luanda.
