JOÃO LOURENÇO NOMEIA JUÍZA EFIGÉNIA CLEMENTE COMO VICE-PRESIDENTE DO TRIBUNAL SUPREMO
A juíza conselheira Efigénia Lima Clemente é a nova vice-presidente do Tribunal Supremo, nomeada, ontem, pelo Presidente da República, João Lourenço, na sequência da eleição à candidatura ao cargo, durante a recente sessão ordinária do Plenário da instância judicial superior da jurisdição comum.
A nova vice-presidente do Tribunal Supremo foi a mais votada entre os três candidatos, tendo alcançado oito votos, contra seis de Daniel Modesto Geraldes e apenas um conquistado por Maria Teresa Marçal André Baptista Borges.
Um Decreto Presidencial, enviado ao Jornal de Angola, refere que a nomeação da juíza Efigénia Lima Clemente sucede à homologação dos resultados do processo de eleição dos candidatos ao cargo, realizado em Plenário, pelo Conselho Superior da Magistratura Judicial.
“O Presidente da República decreta, nos termos da alínea f), do artigo 119º, do nº 4, do artigo 125º e do nº 3, do artigo 180º, todos da Constituição da República de Angola, conjugados com o nº 1, do artigo 20º, da Lei nº 2/22, de 17 de Março – Lei Orgânica do Tribunal Supremo, o seguinte: É nomeada a veneranda juíza conselheira Efigénia Mariquinha dos Santos Lima Clemente para o cargo de vice-presidente do Tribunal Supremo”, lê-se, no documento.
Efigénia Lima Clemente rende no cargo o antigo juiz conselheiro do Tribunal Supremo e vice-presidente, Cristiano Molares de Abril e Silva, que passou à reforma em 2021, tendo durante este período observado uma vacatura no topo da hierarquia dos Tribunais de Jurisdição Comum.
O cargo de vice-presidente do Tribunal Supremo, de acordo com a Constituição, resulta da nomeação entre os três candidatos eleitos durante o Plenário da instância judicial superior da jurisdição comum, seleccionados por 2/3 dos juízes conselheiros em efectividade de funções.
O vice-presidente do Tribunal Supremo tem a competência de substituir o presidente da instância judicial superior da jurisdição comum nas suas ausências e impedimentos, bem como exercer as demais competências estabelecidas por lei ou determinadas superiormente pelo presidente do Tribunal Supremo.
Podem concorrer ao cargo de vice-presidente do Tribunal Supremo, segundo o Regulamento do Processo Eleitoral, os juízes conselheiros em pleno exercício de funções que estejam a exercer ou que tenham exercido a função de presidente de uma das Câmaras do Tribunal Supremo que possuam, pelo menos, cinco anos de antiguidade na categoria e uma classificação mínima de bom na avaliação de mérito nos últimos cinco anos.
Os juízes conselheiros do Tribunal Supremo são nomeados pelo Presidente da República, sob proposta do Conselho Superior da Magistratura Judicial, após concurso curricular de entre magistrados judiciais, magistrados do Ministério Público e juristas de mérito.
