“CÓDIGO PENAL É ARMA DE ARREMESSO CONTRA JORNALISTAS” DIZ TEIXEIRA CÂNDIDO
Teixeira Cândido, secretário-geral do Sindicato dos Jornalistas Angolanos, alerta que a “criminalização da atividade jornalística continua” no país. E diz que os “receios são muitos” em relação às eleições de agosto.
O Código Penal em Angola está a ser usado para criminalizar jornalistas? Um artigo publicado na quinta-feira (30.06) pelo Comité de Proteção aos Jornalistas menciona os casos de três jornalistas angolanos que estão a responder a processos por alegada difamação contra membros do Governo. São eles Escrivão José, Óscar Constantino e Fernando Caetano.
“Estes casos de difamação criminal contra jornalistas em Angola mostram que políticos e figuras poderosas estão a tirar partido das leis da era colonial para criminalizar o jornalismo”, afirmou Angela Quintal, coordenadora do programa para África do Comité de Proteção dos Jornalistas, em Joanesburgo, na África do Sul.
Um exemplo é aquilo que jornalistas tecnicamente chamam de “follow-up”, que é dar seguimento a um tema, algo que pode ser considerado como “perseguição”, de acordo com o atual Código Penal do país. Teixeira Cândido: Tendencialmente, são as figuras políticas ou cidadãos com cargos públicos que mais intentam ações contra os jornalistas. São raros os casos de cidadãos comuns que intentam ações de difamação e calúnia contra os jornalistas. Por exemplo, temos um caso recente do jornalista da Rádio Ecclésia, Óscar Constantino, do Kwanza-Sul. Está a responder por um processo de alegada difamação movido pelo presidente demissionário da Comissão Eleitoral local, que intentou uma outra ação contra o jornalista da Voz da América, Fernando Caetano.
Angola usou até 2020 um Código Penal de cerca de 200 anos. Foi revisto, mas a criminalização da atividade jornalística continua presente. O Código Penal vigente em Angola diz que, por exemplo, aquilo que chamamos tecnicamente de “follow-up”, dar seguimento a uma notícia, pode ser configurado como “perseguição”.
As autoridades angolanas deveriam ter ouvido o apelo da UNESCO para a descriminalização da atividade jornalística. O certo é que temos um Código Penal que defende o contrário e que tem servido como arma de arremesso por parte de titulares de cargos públicos para inibir o exercício do jornalismo.
